premise (write if not in detail and try to be as general as possible):
last year I buy a certified car, put it in service and a few months later it breaks. the manufacturer tells me it depends on the place where I installed it and that I have to make changes on the installation. I change the place as the manufacturer says (or almost, because it makes cabbage reasoning), I make repair the machine from the manufacturer. after a few months it breaks in the usual way: I do repair it again as the manufacturer says (this time obviously repair does not do it him). then it breaks me in a little (and this comes back). At this point I want to intervene by consolidating the part that breaks, so as to avoid concentrations of efforts and redistributing better the stresses with interventions according to the norms of good technique (for example by making proper connection rays instead of living corners, putting thicknesses where they serve, etc.). This is a modification of the initial project to better hold what the manufacturer has done (I have in hand the calculation report of the manufacturer and I see that this part is not sized).
a doubt arises: if I use today I change a machine already certified (dpr459), what should I do? Before the arrival of Legislative Decree 17/10 I checked whether it was a substantial change (pass the term), I was analyzing the risks of the change and if I saw that the change did not introduce new risks, it decreased those present, and did not change the conditions of use provided by the manufacturer I was in place (according to what was envisaged both by dpr459 and by the various actuative circulars).
now d.lgs17 changes the definition of placing on the market and putting into service (no more mention of changes).
my question is: does the logic of dpr459 remain valid or have we also blocked improvements?
