Good morning to all,
between my activities are ctu for the court. I am forced to have to analyze the technical file of the machine. Can I request it directly by pec to the interested party? In addition, the party responsible for the establishment of the technical file did not come into court and was therefore declared contumace. Can I still request the technical file?

My advice is to ask the judge who has given you the assignment of ctu or at least some lawyer friend because it is an exquisitely procedural problem that we engineers are little practical. I have been doing ctu for 25 years but assignments do not have a frequency such as to allow a high specialization in what is now called forensic engineering. in conclusion with lawyers it is better to go cautious because we can not confront them on their field.

in a ctu perhaps it is not expected to acquire any other documentation, depends very much on the question.
If you acquire and then you couldn't, the lawyers will have fun.
