from 1 July p.v. all companies, regardless of the number of workers employed, must be in possession of the risk assessment document.

Article 29 of Legislative Decree 81/2008 provides that employers occupying up to 10 workers, up to the eighteenth month following the date of entry into force of the interministerial decree of the Ministry of Labour, and however no later than 30 June 2012, can certify that they have performed the risk assessment without necessarily processing the document.

therefore self-certification can be carried out by employers until the date of 30 June 2012

The Decree-Law of 12 May 2012, n. 57, was published in the official gazette containing “impressive provisions concerning health and safety in workplaces in transport and micro-enterprises.” which contains the reference to 31 December 2012 of the obligation for micro-enters to carry out risk assessment according to standardized procedures.

the decree-law of 12 May 2012, n. 57, in force from 14 May, provides for the article 1 paragraph 2:

2. to allow the definition of standardized procedures for assessing the risks referred to in Article 6, paragraph 8, letter f), of Legislative Decree no. 81 of 9 April 2008, in Article 29, paragraph 5, second period, of Legislative Decree no. 81, and subsequent modifications, the words: "until the expiry of the eighteenth month following the date of entry into force of the interministerial decree referred to in Article 6, paragraph 8, letter f), and, however, no later than 30 June 2012" are replaced by the following: "until the expiry of the third month following the date of entry into force of the interministerial decree referred to in Article 6, paragraph 8, letter f), and, however, no later than 31 December 2012".

with the beginning of the new year, for enterprises with a number of less than 10 employees, it will be necessary to carry out the real assessment of the risks, not being able to count from 31/12/2012 on the only self-certification. in case of non-evaluation of risks, as a result of control by supervisory bodies, micro enterprises will also have to respond to the sanctions provided by Legislative Decree 81/08 for all types of enterprise.

It should be said that the simplified procedures can now be used to fulfil the obligation to assess risks.
